Terms and Conditions
GENERAL
These terms and conditions govern the use of the website Espresso Underground and the purchase of products through espressounderground.co.uk (referred to as "The Company"). By placing an order, you agree to be bound by these terms. Our website offers a wide range of coffee machines, coffee machine spare parts, accessories, and consumables, catering primarily to trade customers but also available to all customers under the conditions outlined here.
In the event of any conflict between the purchaser's written conditions and these terms, the Company's terms shall prevail unless explicitly agreed otherwise in writing. Nothing in these terms will deprive the purchaser of their statutory rights under UK law.
QUOTATIONS
All quotations provided by the Company are valid for acceptance within 15 days from the date of issue. After this period, the quotation will expire. The Company reserves the right to refuse any order at its discretion.
DELIVERY
- Deliveries will be made to the address provided on the payment receipt, unless otherwise specified during the order process. All orders will incur a delivery charge unless collection arrangements are made at the time of purchase. Goods are typically dispatched by courier, except for certain offshore deliveries, which are sent via Royal Mail Special Delivery. For detailed information on delivery charges, please contact us at sales@espressounderground.co.uk.
- Orders placed online at espressounderground.co.uk by 3 p.m. (Monday to Friday) will generally be dispatched the same day if paid via PayPal, with the exception of specific items like chemicals. Orders paid through WorldPay will be dispatched within five working days. Orders placed after 3 p.m. on Friday or during bank holidays will be processed on the next working day. Although we strive to dispatch orders within 48 hours, the Company cannot guarantee same-day dispatch. Estimated stock arrival dates are provided as guidance only.
- Some back orders are dispatched via Royal Mail Recorded Delivery and will typically arrive within 5 working days from the dispatch date. Stock arrival dates remain estimates and are not guaranteed.
- All goods sent by the Company will require a signature upon delivery. If a signature cannot be obtained, the goods will not be left and will be returned to the depot for redelivery.
- Standard deliveries are dispatched within 48 hours after receipt of the order. For PayPal transactions, orders received between 8 a.m. and 3 p.m. on a working day are eligible for next-working-day delivery, subject to location and courier availability. Working days are Monday to Friday, excluding Bank Holidays. Urgent deliveries, including timed or Saturday deliveries, can be arranged but are subject to additional charges and specific terms. Requests for special deliveries should be made when placing the order. Timed deliveries, such as 9 a.m. slots, may result in delivery as early as 7 a.m. If a signature cannot be obtained, the goods will be returned for redelivery on the next working day.
- The Company will not be liable for any consequential loss or damage resulting from failure or delay in delivery due to circumstances beyond its control. We strongly advise that installations or service calls are not scheduled until the goods have been received.
LOSS & DAMAGE IN TRANSIT
All losses or damage to products in transit within the UK must be reported to both the courier and the Company within 24 hours of receipt. Claims for damaged goods will only be considered if the delivery note is marked "Unexamined" or "Packaging Damaged" upon signing. Claims for missing or damaged goods where no signature is recorded will be rejected.
For International Orders, customers are advised to request shipping insurance at the time of purchase. Once dispatched, the responsibility for goods falls with the customer if insurance is not selected.
RETURNS & WARRANTY FOR PARTS AND ACCESSORIES
Returns are accepted only by prior arrangement and are subject to a 25% handling and restocking fee if the correct part has been supplied. Special order parts cannot be returned or cancelled. We must be notified of any damaged or faulty goods within 3 days of receipt to process returns.
All replacement parts are guaranteed for six months. We will repair or replace faulty goods at our discretion. Wearable parts, such as group seals, are not covered under warranty. Items returned with signs of misuse, improper cleaning, or incorrect use will not be eligible for credits or replacements. Electrical components like PCBs and touch panels are supplied without warranty.
WARRANTIES FOR COFFEE MACHINES AND GRINDERS
- All coffee grinders sold through Espresso Underground come with a 12-month return-to-base parts and labor warranty. Customers experiencing issues with a grinder should contact us with details and, if possible, a photograph of the issue.
- The warranty on our coffee grinders does not cover misuse or improper handling. Before using your grinder, please ensure the grinder blades are properly adjusted to avoid contact and are set for coarser coffee, if applicable. MC2 Grinders are specifically recommended for domestic use only and may not be suitable for commercial settings.
- If your coffee grinder can be repaired by replacing specific coffee machine parts, we will charge for the required items and provide a credit upon receipt of the faulty parts.
- If a grinder needs to be returned for repair, please request an RMA (Return Merchandise Authorisation) number by logging into your account at espressounderground.co.uk, selecting the "returns request" option, and following the on-screen instructions.
- Please note that grinder repairs may take up to two weeks, and you will be responsible for shipping costs to return the grinder. In rare cases, if the product is found to be beyond economical repair, we will replace the unit at no additional cost to you.
- For commercial espresso coffee machines, the warranty may vary between parts-only and full parts and labor coverage, depending on the agreement at the time of purchase. All warranty repairs for domestic coffee machines must be returned in their original packaging. Machines used in a commercial setting will void the domestic warranty unless an extended warranty is purchased at the time of sale.
Products purchased across borders are supplied with a parts only warranty.          Â
PRICES & PAYMENT
- All prices are subject to change without notice, and goods will be invoiced at the prices in effect at the time of delivery. Prices quoted for goods are exclusive of VAT unless otherwise stated. Buyers outside the European Union will not be charged VAT, though they may be liable for import duties and taxes in their respective countries.
- Until full payment has been received, all goods supplied shall not be dispatched.
OWNERSHIP OF GOODS
The risk in the goods passes to the Purchaser upon delivery; however, the beneficial ownership remains with the Company until full payment is received. The legal title of the goods will remain with the Company until the Purchaser has fully paid for the goods and any other goods or services previously or subsequently supplied by the Company. Once full payment has been made, the title will pass to the Purchaser.
The Purchaser may sell the goods in the normal course of business as the fiduciary agent of the Company, but this right will automatically cease if a receiver, manager, or administrator is appointed over the Purchaser's assets or property. Until ownership passes to the Purchaser (and as long as the goods are still in existence and have not been resold), the Company reserves the right to request the Purchaser return the goods. If the Purchaser fails to comply, the Company may enter the Purchaser's premises, or those of a third party where the goods are stored, to repossess them.
COPYRIGHT
All content on Espresso Underground's website, including images, text, and media, is the property of the Company and is protected under copyright law. Unauthorised use or reproduction of this content without the Company's express written consent is prohibited.
FORCE MAJEURE
The Company shall not be liable for any failure or delay in delivering goods or performing obligations due to circumstances beyond its control, including but not limited to acts of God, war, civil unrest, strikes, or natural disasters.
SEVERABILITY
If any provision of these terms is found to be invalid or unenforceable by a court, the remainder of the provisions shall remain in full force and effect.
APPLICABLE LAW
These terms and conditions are governed by the laws of England and Wales. Any disputes arising from the use of this website or purchases made will be subject to the exclusive jurisdiction of the courts of England and Wales.
